Welcome to Attenda. These Terms of Service ("Terms") govern your use of the Attenda no-show protection service ("Service") operated by Attenda ("we", "us", or "our"). By accessing or using our Service, you agree to be bound by these Terms.
1. Service Description
Attenda provides a no-show protection service for appointment-based businesses. Our Service includes:
- Calendar integration to monitor your appointments
- Automated confirmation messages to your clients
- Card authorization to secure appointments
- No-show fee processing when you confirm a client did not attend
2. Account Registration
2.1 Eligibility
You must be at least 18 years old and have the legal capacity to enter into contracts. By registering, you represent that you are a legitimate business or professional providing appointment-based services.
2.2 Account Security
You are responsible for maintaining the security of your account. You must:
- Provide accurate and complete registration information
- Keep your login credentials confidential
- Notify us immediately of any unauthorized access
- Not share your account with others
3. Subscription and Payment
3.1 Plans and Pricing
We offer different subscription plans with varying features and limits. Current pricing is available on our website and may change with notice.
3.2 Billing
- Subscriptions are billed monthly in advance
- All fees are non-refundable unless otherwise stated
- We use Stripe for payment processing
- You authorize us to charge your payment method automatically
3.3 Free Trial
We may offer a free trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid plan.
4. Use of the Service
4.1 Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
- Use the Service for any fraudulent or deceptive purposes
- Charge clients for services not actually booked or provided
- Misrepresent your no-show policy to clients
- Violate any applicable laws or regulations
- Interfere with or disrupt the Service
- Attempt to gain unauthorized access to our systems
4.2 Your Responsibilities
As a user of our Service, you are responsible for:
- Clearly communicating your no-show policy to clients
- Accurately marking attendance status for appointments
- Responding to client disputes in a timely manner
- Complying with consumer protection laws in your jurisdiction
- Maintaining appropriate records of appointments and charges
5. No-Show Charges
5.1 Authorization Process
When a client confirms an appointment through our Service, their card is authorized (not charged) for the no-show fee amount you specify. This authorization:
- Temporarily holds the amount on the client's card
- Does not transfer any funds
- Expires automatically if not captured
5.2 Charging for No-Shows
Important: We will only charge a client's card when you explicitly mark an appointment as a no-show. Charges are never processed automatically. You must ensure that:
- The client was properly informed of your no-show policy
- The client actually failed to attend or cancel appropriately
- The charge complies with your stated policy and applicable laws
5.3 Disputes and Refunds
If a client disputes a charge, you are responsible for resolving the dispute. Excessive chargebacks may result in account suspension or termination.
6. Intellectual Property
The Service, including all content, features, and functionality, is owned by Attenda and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our permission.
7. Privacy and Data
Your use of the Service is subject to our Privacy Policy. By using the Service, you consent to our collection and use of data as described therein.
8. Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided "as is" without warranties of any kind
- We are not liable for any indirect, incidental, or consequential damages
- Our total liability is limited to the fees you paid in the past 12 months
- We are not responsible for actions taken by your clients or third parties
9. Indemnification
You agree to indemnify and hold Attenda harmless from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
10. Termination
10.1 By You
You may cancel your subscription at any time. Your account will remain active until the end of your billing period.
10.2 By Us
We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason with reasonable notice.
10.3 Effect of Termination
Upon termination, your right to use the Service ends. We may retain certain data as required by law or for legitimate business purposes.
11. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use constitutes acceptance of the modified Terms.
12. Governing Law
These Terms are governed by applicable international laws and the laws of your jurisdiction. Any disputes shall be resolved through arbitration or in courts of competent jurisdiction.
13. General Provisions
- Entire Agreement: These Terms constitute the entire agreement between you and Attenda.
- Severability: If any provision is found invalid, the remaining provisions remain in effect.
- No Waiver: Failure to enforce any provision does not waive our right to enforce it later.
- Assignment: You may not assign your rights under these Terms without our consent.
